Acceptance of Terms

By accessing or using the Amys Creations website (amyscreations.us), you accept and agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use our site or place an order. These Terms apply to all visitors, customers, and anyone else who accesses or uses our site, including scheduling or attending an in-store fitting appointment.

Use of Website

You may use our site to browse and purchase quinceañera gowns, special-occasion dresses, and accessories for lawful personal purposes only. You agree not to misuse the site, attempt unauthorized access to our systems or customer data, copy, scrape, or resell our product photography or written descriptions, impersonate another person or entity, or interfere with other customers' use of the site. Violation of these conditions may result in suspension of your ability to order from us.

Account and Order Accuracy

When you place an order, you are responsible for providing accurate shipping and contact information, including your correct size selections and event date if relevant to alteration scheduling. We are not responsible for delays or errors caused by inaccurate information provided at checkout, though we will do our best to help correct mistakes when contacted promptly.

Products, Pricing, and Availability

All prices are listed in US dollars and may change without notice; the price in effect at the time you place your order is the price you will be charged. Gowns are made-to-order and fitted in-store; sizes and colors shown are representative and may vary slightly due to dye lots, fabric availability, and monitor color rendering. We make every effort to display gowns and accessories accurately, but we do not warrant that product descriptions or images are completely error-free. We reserve the right to limit quantities, refuse, or cancel any order at our discretion, including in cases of suspected fraud, pricing errors, or inventory unavailability, in which case we will issue a full refund for the cancelled portion of your order.

In-Store Fitting and Alterations

Many gowns require an in-store fitting appointment for alterations to be worn correctly for a specific ceremony. Alteration timelines depend on appointment availability and are scheduled separately from online order fulfillment; please contact us as soon as possible after ordering to reserve a fitting slot ahead of your event date. Amys Creations is not responsible for scheduling conflicts that arise from booking a fitting appointment too close to an event date, and we encourage all customers to book fittings well in advance, particularly during peak quinceañera season in the spring and fall.

Payment

Payment is processed securely through PayPal at checkout. We accept PayPal balance, Visa, Mastercard, American Express, and Discover through PayPal's payment gateway. Your order is not confirmed until payment has been successfully authorized. We do not store your full card number on our servers.

Intellectual Property

All content on this site — including text, photography, garment designs, layout, and the Amys Creations name and logo — is the property of Amys Creations LLC and is protected by U.S. copyright and trademark law. You may not reproduce, distribute, or create derivative works from our content without prior written permission.

Limitation of Liability

To the fullest extent permitted by law, Amys Creations LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of this site or the products purchased through it, including delays related to event scheduling, shipping carrier delays, or fitting-appointment availability. Our total liability for any claim arising from your use of our site or products shall not exceed the amount you actually paid for the order giving rise to the claim.

Disclaimer of Warranties

Our site and products are provided "as is" and "as available" without warranties of any kind, either express or implied, except as explicitly stated in our Return & Refund Policy. We do not warrant that our site will be uninterrupted, error-free, or completely secure at all times.

Indemnification

You agree to indemnify and hold Amys Creations LLC harmless from any claims, damages, or expenses arising from your violation of these Terms of Service or your misuse of our website.

Governing Law

These Terms are governed by the laws of the State of Colorado, USA, without regard to conflict-of-law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Adams County, Colorado, and you consent to the personal jurisdiction of those courts.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

Changes to These Terms

We may update these Terms of Service from time to time to reflect changes in our business practices or for legal and regulatory reasons. Continued use of our site after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.

Age Requirement

Our website and checkout are intended for use by individuals who are at least 18 years old, or by a parent or guardian placing an order on behalf of a minor celebrating a quinceañera, sweet sixteen, or prom. By placing an order, you represent that you are either 18 years of age or older, or the parent or guardian of the person for whom the gown is being purchased.

Third-Party Links

Our site may contain links to third-party websites, such as PayPal's checkout pages or shipping carrier tracking pages, that are not owned or controlled by Amys Creations LLC. We are not responsible for the content, privacy policies, or practices of any third-party sites. We encourage you to review the terms and privacy policies of any third-party site you visit.

Force Majeure

Amys Creations LLC shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to natural disasters, severe weather, carrier disruptions, labor disputes, or supply chain interruptions affecting fabric or trim availability. In such cases, we will communicate any expected delays as soon as we are aware of them.

Dispute Resolution

If a dispute arises between you and Amys Creations LLC, we encourage you to first contact us directly at support@amyscreations.us so we can attempt to resolve the issue informally. If a dispute cannot be resolved informally within a reasonable time, either party may pursue formal resolution through the courts of Adams County, Colorado as described in the Governing Law section above.

Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. Amys Creations LLC may assign these Terms in connection with a merger, acquisition, or sale of substantially all of our assets without restriction.

No Waiver

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of that right or provision. Any waiver of a provision must be in writing and signed by an authorized representative of Amys Creations LLC.

Entire Agreement

These Terms of Service, together with our Privacy Policy, Return & Refund Policy, and Shipping Policy, constitute the entire agreement between you and Amys Creations LLC regarding your use of our website and purchase of our products, and supersede any prior agreements or understandings, whether written or oral.

Order Confirmation and Communication

By placing an order, you consent to receive transactional emails and text messages related to your order, including confirmations, shipping updates, and fitting-appointment reminders. Promotional emails are opt-in and separate from these transactional communications, and you may unsubscribe from promotional messages at any time without affecting your ability to receive order-related communications.
